Installation Authorization Terms
- The undersigned is the owner of the Property (“Property Owner”) or is authorized to sign this Addendum on behalf of and bind the Property Owner.
- Property Owner understands the Installed Item is for home use and not commercial applications. Property Owner has investigated and understands all applicable covenants, rules, codes, requirements, standards, laws, regulations and product manufacturer instructions, pertaining to the proper use and location, including the surface on and/or over which it will be installed (individually and collectively, the “Requirements”), of the Installed Item on the Property. With that knowledge, Property Owner has designated the location on the Property and instructs and authorizes Go Configure to install the Installed Item at that location.
- Go Configure has not made any recommendation, representation or warranty regarding the use or location of the Installed Item on the Property, including the surface on and/or over which it will be installed. In determining the use or location for the Installed Item, including the surface on and/or over which it will be installed, Property Owner has not relied upon any statement made by Go Configure.
- Property Owner has full authority and has obtained all required approvals, permissions, permits and variances, necessary to have the Installed Item installed on the Property at the location designated by the Property Owner in compliance with the Requirements.
- Property Owner represents that the intended use and installation of the Installed Item at the location on the Property designated by the Property Owner, including the surface on or over which it will be installed, complies with the Requirements. As between Property Owner and Go Configure, Property Owner assumes all risk, including any risk of relocation or removal, arising from the use and/or location of the Installed Item, including the surface on and/or over which it will be installed.
- Property Owner agrees and represents that Property Owner and all persons permitted by Property Owner to use or access the Installed Item will follow all instructions and warnings relating to the Installed Item provided to or for Property Owner by the manufacturer and/or seller of the Installed Item and/or Go Configure.
- Property Owner shall indemnify, defend and hold harmless Go Configure, its owners, employees, officers, insurers and affiliated companies from and against any and all claims, demands, causes of action, action or proceedings for any injury, damage, loss, destruction, expense, fine or penalty arising from: (i) the use and/or location of the Installed Item, including the surface on and/or over which it is installed; and (ii) a breach of paragraph 6 of this Installation Authorization.
